Suspecting tax evasion, the Enforcement Wing of the Commercial Taxes Department on Thursday conducted searches on 40-odd premises of Hotel Saravana Bhavan across the city and suburbs.

The searches began at 7 a.m. by a team of more than 100 personnel. “Searches were conducted on suspicion that there could be evasion of sales [Value Added Tax], undermining the sales,” said a senior official of the Commercial Taxes Department.

Data collected

Data and records were being collected to be compared with the declarations made by the company in the past, and the declaration pertaining to the current taxation period. Only then could an opinion be formed whether or not there was tax evasion, officials said.

The food chain is very popular in the city. It has a number of branches in the country and abroad.

The premises that were searched included 29 branches, stores, kitchens and service centres. The operation was expected to continue on Friday to cover all branches, the official said.

Combo pack

Speaking on behalf of the company, K. Kamalakannan, creative in-charge, told The Hindu that the food chain recently introduced a combo pack for breakfast, lunch and dinner. The pack had assorted items at a reasonable price, offering many of the items on the menu in smaller quantities. This proved a hit, and the sales went up. Perhaps, the officials were trying to ascertain whether the firm had declared the actual sale volume for VAT remittance, he said.

Asserting that there was no suppression of facts or tax evasion, he said the company was co-operating with officials so that the search could be completed at the earliest.

CHENNAI: The sales tax authorities raided the offices and restaurants of Hotel Saravana Bhavan on Thursday on suspicion of tax evasion. 

A source from the Sales Tax department, who confirmed the raids, on condition of anonymity, said, "We suspect omissions in sales declaration. We are checking the entire day's sales transactions. We are comparing it with the last declaration made by the hotel." 

"Officials began the raid in big outlets of the chain in Chennai and Kancheepuram early today. We will monitor the sales in all these outlets till they down shutters late in the night.

"We will check the sales in each of the outlets today and then compare it with the previous declaration of sales given by Saravana Bhavan. If the difference is more than 10 per cent, we will flag it for appropriate action," the official said. 

Hotel Saravana Bhavan, which on an average attracts 80,000 customers daily across its over-35 outlets in India, cut down food prices in October 2013 due to fall in footfalls. Rivals like Adyar Ananda Bhavan followed suit. On an average, these restaurants slashed prices by 10-20 per cent. 

A source at Saravana Bhavan said: "The footfalls increased post price cut which is a common phenomenon everywhere. When price falls demand does up. Anyways our books are clean and we have nothing to hide," he added. 

Hotel Saravana Bhavan, which started with a small food outlet in a middle-class neighbourhood in Chennai in 1981, now has more restaurants overseas than in India. The chain now has 35 branches in India and 54 overseas, in places such as the US, Canada, Singapore, West Asia and the UK.

J. J. Bhabha's Meherangir bungalow

The J. J. Bhabha bungalow called Meherangir located at Malabar Hills was successfully sold by NCPA for Rs 372 crore after conclusion of a public auction on Wednesday as per the provisions of Bombay Public Trust Act, 1950.

As per request of the winning bidder, their identity was not disclosed by NCPA. The minimum reserve price for the bungalow was set at Rs 257 crore and the auction was held between three interested parties.

Dr. Jamshed Bhabha, under his last will and testament, bequeathed his estate, including Meherangir to the NCPA.

The proceeds from this auction will be used to help further the cause through modernisation of the theatres, up gradation of the equipment and expand the activities and thereafter fulfill the dreams and legacy of Dr Jamshed Bhabha, said the NCPA management in a press conference held in Mumbai.

"As India's premier cultural institution that is committed to serve the cause of the performing and allied arts, it is NCPA’s dictum to preserve and promote country's rich and vibrant heritage of Indian and international music, dance, theatre, film, literature and photography as well as presenting new and innovative work in the field of the performing arts," said a press statement issued by the NCPA.

NCPA inheritance

Clarifying its stand on the controversy NCPA said Dr Homi Bhabha was only a part owner of the property, along with his mother and his brother Dr Jamshed Bhaba, till his demise in 1966 and the property subsequently devolved solely upon Dr Jamshed who bequeathed it to the NCPA by his Will, which has since been probated.

"Following the specific instructions of Dr Jamshed Bhabha contained in his said Will, the NCPA has put up the property for sale, strictly following the process laid down in the Bombay Public Trust Act, and is hence auctioning the property. The Will made it very clear that the property apart from some small personal bequests was to devolve solely on the NCPA, a recognised charitable institution of national importance lovingly created by the late Dr Jamshed Bhabha, to endow it with sufficient funds solely for the furtherance of its objectives," said NCPA in a statement.

"The Will also directed that a suitable segment of his bequest be earmarked in his name at the NCPA. We have taken legal opinion of eminent counsel which confirms the correctness of the bid process followed by us. As this is a legal requirement, there is no question of bypassing this procedure," added THE NCPA statement.

Sale opposed

The sale faced opposition from some employees of the Bhabha Atomic Research Centre, who had demanded that the property be turned into a museum in Homi Bhabha’s memory.

A public interest litigation was filed but the Bombay High Court declined to stay the auction.

The controversy did lead to five potential bidders backing out, leaving only three in the fray. The court has now set June 23 as the date for the next hearing on the issue.

பழங்கால பாரம்பரிய முறையில் உயர் நீதிமன்ற கட்டிடங்களின் மேற்கூரைகளை சீரமைப்பு செய்யும் பணிகள் தொடங்கியுள்ளன.

1892-ம் ஆண்டு கட்டப்பட்ட சென்னை உயர் நீதிமன்ற கட்டிடம் இந்தோ-சார்சனிக் கட்டிடக் கலைக்கு மிகச் சிறந்த உதாரணமாகத் திகழ்கிறது. 120 ஆண்டுகளைக் கடந்த சென்னை உயர் நீதிமன்ற கட்டிடங்களை பெரிய அளவில் சீரமைப்பு செய்வதற்கான நடவடிக்கைகள் இப்போது தொடங்கப்பட்டுள்ளன. அதே நேரத்தில் கட்டிடத்தின் தொன்மை மாறாமல் சீரமைப்பு பணிகளை மேற்கொள்ள ஏற்பா டுகள் செய்யப்பட்டுள்ளன.

உயர் நீதிமன்ற உத்தரவின்படி அமைக்கப்பட்ட உயர் நீதிமன்ற புராதானக் கட்டிடங்களை பாதுகாப்பதற்கான குழு, வளாகத்தில் உள்ள கட்டிடங்களை அண்மையில் ஆய்வு செய்தது. அந்தக் குழுவின் அறிக்கை சமர்ப்பிக்கப்பட்ட பின் பெரிய அளவிலான சீரமைப்புப் பணிகள் நடைபெறும் என தெரிகிறது.

இதற்கிடையே உயர் நீதிமன்ற கட்டிடத்தின் கலச மாடங்களில் கட்டிடம் கட்டப்பட்ட ஆண்டில் பூசப்பட்ட அதே வண்ணத்தையே இப்போதும் பூசத் திட்டமிட்டுள்ளனர்.

பழைய வண்ணம் எந்த வகையைச் சார்ந்தது, அந்த வண்ணத்தில் கலந்துள்ள வேதிப் பொருள்கள் என்னென்ன போன்ற விவரங்களை அறிவதற் காக கலச மாடத்திலிருந்து மாதிரி வண்ணப் பூச்சு சேகரிக்கப்பட்டு, கல்பாக்கத்தில் உள்ள இந்திராகாந்தி அணு ஆராய்ச்சி மையத்துக்கு அனுப்பி வைக்கப் பட்டதாக தெரிகிறது.

அங்கிருந்து மும்பையில் உள்ள ஒரு ஆய்வுக் கூடத்துக்கு வண்ணப்பூச்சின் மாதிரி தற்போது அனுப்பி வைக்கப்பட்டுள் ளதாகவும், ஆய்வின் முடிவுக்காக காத்திருப்பதாகவும் தகவல் அறிந்த வட்டாரங்கள் தெரிவித்தன.

இதற்கிடையே மழைக் காலங்களில் உயர் நீதிமன்றக் கட்டிடத்தில் நீர்க் கசிவு ஏற்படும் மேற்கூரைப் பகுதிகளைக் கண்டறிந்து, அவற்றை சீரமைக்கும் பணிகள் தற்போது தொடங்கி யுள்ளன. இந்தப் பணிகளும் தொல்லியல் துறை நிபுணர்களின் ஆலோசனையுடன் பழங்கால பாரம்பரிய முறைப்படியே நடைபெற்று வருகின்றன.

ராஜபாளையம் பகுதியிலிருந்து சுட்ட சுண்ணாம்புக் கல் மூட்டைகள் வரவழைக்கப்பட்டுள்ளன. அதனை தண்ணீரில் கரைத்து சுண்ணாம்பு பால் தயாரிக்கிறார்கள்.

அந்த சுண்ணாம்புப் பாலை ஆற்று மணலில் நன்கு கலந்து, அந்தக் கலவையை சுமார் 10 நாள்கள் வரை நன்கு ஊற வைக்கின்றனர்.

அதேநேரத்தில் கடுக்காய்களை உடைத்து அந்தத் தூளை, கருப்பட்டி வெல்ல சர்க்கரைத் தூளுடன் சேர்த்து ஊற வைக்கின்றனர்.

சுமார் 3 நாள்கள் இந்தக் கலவை ஊறிய பின், இந்தக் கலவையின் கரைசலை சுண்ணாம்பு மணல் கலவையுடன் சேர்த்து புதிய கலவையை உருவாக்குகிறார்கள்.

இந்தக் கலவையை கட்டிடத்தின் மேற்கூரையில் பரப்பி அதன் மேல் நாட்டு ஓடுகளைப் பதிக்கின்றனர். நாட்டு ஓடுகளின் மேல் மீண்டும் கடுக்காய், கருப்பட்டி, சுண் ணாம்பு கலவையை கொட்டி மேற்கூரையை சீரமைக்கும் பணிகள் மேற்கொள் ளப்படுகின்றன.

இந்தப் பணிகளுக்காக தற்போது சுண்ணாம்பு கலவை மற்றும் கடுக்காய், கருப்பட்டி வெல்ல சர்க்கரை கலவை தயாரிக்கும் பணிகளில் தொழிலாளர்கள் தீவிரமாக ஈடுபட்டுள்ளனர்.

பாரம்பரியமான தொழில் நுட்பங்களைப் பயன்படுத்தி நடைபெறும் இந்தப் பணிகளை வழக்கறிஞர்களும், நீதிமன்ற ஊழி யர்களும் பெருமளவில் வேடிக்கை பார்த்தபடி செல்கின்றனர்.

ஜெயலலிதா வழக்கில் மேலும் 5 தனியார் நிறுவனங்கள் மனு தாக்கல்

தமிழக முதல்வர் ஜெயலலிதா மீதான சொத்துக்குவிப்பு வழக்கில் முடக்கி வைக்கப்பட்டுள்ள தங்களின் சொத்துகளை உடனடி யாக விடுவிக்கும்படி ஜெ ரியல் எஸ்டேட் உள்ளிட்ட 5 தனியார் நிறுவனங்கள் சார்பாக பெங்களூர் சிறப்பு நீதிமன்றத்தில் மனு தாக்கல் செய்யப்பட்டது.

இந்த மனுக்கள் மீது வரும் புதன்கிழமை விசாரணை நடை பெறவுள்ளது. ஜெயலலிதா, சசிகலா, சுதாகரன், இளவரசி ஆகியோர் மீதான சொத்துக்குவிப்பு வழக்கில் 33 தனியார் நிறுவனங்கள் இணைக்கப்பட்டுள்ளன. அதில் லெக்ஸ் பிராப்பர்ட்டீஸ் உள்ளிட்ட 5 தனியார் நிறுவனங்கள் இரு மாதங்களுக்கு முன்பு மனு தாக்கல் செய்தன. 

அந்த மனுக்கள் மீதான விசாரணை பெங்களூர் சிறப்பு நீதிமன்ற நீதிபதி ஜான் மைக்கேல் டி'குன்ஹா முன்னிலையில் திங்கள்கிழமை நடைபெற்றது.

அப்போது கிரீன் ஃபார்ம் ஹவுஸ் நிறுவனத்தின் நிர்வாக இயக்குநர் பாலாஜி ஆஜரானார். ‘மற்ற 4 நிறுவனங்களின் நிர்வாக இயக்குநர் சுரேஷ் குமாருக்கு மஞ்சள் காமாலை. அதனால் அவர் மருத்துவமனையில் சிகிச்சை பெற்றுவருகிறார். 

எனவே அவரால் நீதிமன்றத்தில் நேரில் ஆஜராக முடியவில்லை' என ஜெயலலிதா தரப்பு வழக்கறிஞர்கள் தெரிவித்தனர்.

அதற்கு நீதிபதி, ‘அவருடைய முகவரியை நீதிமன்றத்திடம் அளியுங்கள். அவருக்கு சம்மன் அனுப்புகிறோம்' என்றார். 

இதனைத் தொடர்ந்து வழக்கின் விசாரணையை புதன்கிழமைக்கு ஒத்திவைத்தார்.

சொத்துக் குவிப்பு வழக்கு தொடர் பாக தமிழக முதல்வர் ஜெயலலிதா தொடர்ந்துள்ள வழக்கை விசா ரிக்க உச்ச நீதிமன்ற நீதிபதி தன் தயக்கத்தை தெரிவித்தார்.

தமிழக முதல்வர் ஜெயலலிதா மீதான சொத்துக் குவிப்பு வழக்கு பெங்களூரில் உள்ள சிறப்பு நீதி மன்றத்தில் நடந்து வருகிறது. இந்த வழக்கில் தொடர்புடைய சொத்து தன்னுடையது என்று லெக்ஸ் பிராப்பர்டீஸ் என்ற நிறுவனம் உரிமை கோரியுள்ளது.

இதில் முடிவு தெரியும்வரை பெங்களூரில் நடைபெறும் சொத்துக் குவிப்பு வழக்குக்கு தடை விதிக்க வேண்டும் என்று ஜெயலலிதா மனு தாக்கல் செய்திருந்தார்.

இந்த மனுவை ஏற்று இடைக்கால தடை விதிக்கப்பட்டுள்ளது. தடையை நீக்கக் கோரி, திமுக பொதுச் செயலா ளர் க.அன்பழகன் மனு தாக்கல் செய் துள்ளார். 

இந்நிலையில், இந்த வழக்கு விசாரணை நீதிபதிகள் விக்ரம்ஜித் சென், சிவ கீர்த்தி சிங் முன்பு திங்களன்று விசாரணைக்கு வந்தது.

மனுவைப் பார்த்த நீதிபதி விக்ரம் ஜித்சென், ‘இந்த வழக்கை நான் விசாரிப்பதில் உங்களுக்கு ஆட்சே பணை உண்டா?’ என்று கேட்டார். நீதிபதி விக்ரம்ஜித்சென், கர்நாடக உயர் நீதிமன்றத்தின் தலைமை நீதிபதியாக இருந்தவர். சொத்துக் குவிப்பு வழக்கில் அரசு வழக்கறிஞர் நியமனம் உள்ளிட்ட பல மனுக்கள் அவரிடம் விசாரணைக்கு வந்ததால் நீதிபதி இவ்வாறு குறிப்பிட்டார்.

ஜெயலலிதா தரப்பில் ஆஜரான வழக்கறிஞர் சேகர் நாப்தே, ‘ஆட் சேபணை எதுவும் இல்லை’ என்றார். 

இதையடுத்து, மனு விசாரணைக்கு எடுக்கப்பட்டது. இருதரப்பிலும் தாக்கல் செய்யப்பட்டுள்ள மனுக்களை படிக்க வேண்டியிருப்பதால் வழக்கை செவ்வாயன்று விசாரணைக்கு எடுத்துக் கொள்வதாக நீதிபதிகள் அறிவித்து ஒத்திவைத்தனர்.

அன்பழகனுக்கு தகுதி இல்லை

முன்னதாக, தமிழக அரசு சார்பில் தாக்கல் செய்யப்பட்டுள்ள பதில் மனுவில் கூறியிருப்பதாவது:

இடைக்கால தடையை நீக்கக் கோரி க.அன்பழகன் மனு தாக்கல் செய்துள் ளார். அவர் ஒரு அரசியல் கட்சியின் பொதுச் செயலாளர். அவருக்கும் இந்த வழக்குக்கும் தொடர்பில்லை.

அரசு வழக்கறிஞர் பாரபட்சமின்றி நடுநிலையுடன் நடந்து கொள்வது அவரது கடமை. அதில் தலையிடு வதும், அவரது நடத்தையில் குறை சொல்வதும் நீதிமன்ற நடவடிக்கையில் தலையிடும் செயலாகும். சொத்துக் களை முடக்கி வைத்துள்ள உத்தரவை வாபஸ் பெற கடந்த மாதம் 26-ம் தேதி ஏற்கெனவே மனு தாக்கல் செய்யப்பட்டுள்ளது.

அன்பழகன் தரப்பில் கூறப்பட் டுள்ள குற்றச்சாட்டுகளில் உண்மை இல்லை. இந்த வழக்கில் தலையிட அவருக்கு தகுதி இல்லை. எனவே, அவரது மனுவை தள்ளுபடி செய்ய வேண்டும். இவ்வாறு பதில் மனுவில் கூறப்பட்டுள்ளது.

மனு அவசியம் இல்லை

பெங்களூர் வழக்குக்கு தடை கோரி தாக்கல் செய்யப்பட்டுள்ள மனுவுக்கு லஞ்ச ஒழிப்புத் துறை சார்பில் தாக்கல் செய்துள்ள பதில் மனுவில் கூறியிருப்பதாவது:

இது வழக்கை காலதாமதப் படுத்த தொடரப்பட்டுள்ள மனு. சொத்து வழக்கு 2010-ம் ஆண்டு முதல் நடந்து வருகிறது. வழக்கு முடியும் தருவாயில் உள்ளது.

இந்த வழக்கு பெங்களூர் சிறப்பு நீதிமன்றத்துக்கு மாற்றப்பட்ட போது, சொத்துக்களை முடக்கி பிறப்பிக்கப்பட்ட உத்தரவுகள் மாற்றப்படவில்லை.

லெக்ஸ் பிராபர்டீஸ் தொடர்பான வழக்கு கர்நாடக உயர் நீதிமன்றத்தில் அடுத்த மாதம் 4-ம் தேதி விசாரணைக்கு வருகிறது. மொத்தம் 12 நிறுவனங்கள் சொத்துக்களை தங்களுடையவை என்று கோரியுள்ளன.

இந்த நிறுவனங்களின் சொத்துக்கள் ஏற்கனவே சிறப்பு நீதிமன்றத்தின் கட்டுப்பாட்டில் உள்ளதால், சொத்துக்களை முடக்கும் உத்தரவை வாபஸ் பெறுவதாக கடந்த மாதம் 26-ம் தேதி அரசு வழக்கறிஞர் மனு தாக்கல் செய்துள்ளார். எனவே, ஜெயலலிதா தரப்பில் தாக்கல் செய்துள்ள மனுவுக்கு இப்போது அவசியம் இல்லை.

இவ்வாறு பதில் மனுவில் கூறப்பட்டுள்ளது.
