முதல்வர் ஓ.பன்னீர்செல்வத்தை சந்திக்க ஜெயலலிதா மறுப்பு

தமிழக முதல்வர் ஓ.பன்னீர் செல்வம் மற்றும் அமைச்சர்கள் உள்ளிட்டோரை ஜெயலலிதா சந்திக்க மறுத்துவிட்டார். இதனால் நேற்று முழுவதும் ஹோட்டல் அறையில் காத்திருந்த அனைவரும் இரவில் சென்னைக்கு திரும்பினர்.

'ஆட்சி நிர்வாகத்தில் கவனம்'

தமிழக முதல்வரை, முன்னாள் முதல்வர் ஜெயலலிதா சந்திக்க மறுப்பு தெரிவித்தது ஓ.பி.எஸ். அரசு நிர்வாகத்தில் கவனம் செலுத்த வேண்டும் என்பதற்காகவே எனத் தெரிகிறது. இதனை சிறை ஊழியர் வாயிலாக ஜெயலலிதாவே ஓ.பன்னீர்செல்வத்திற்கு தெரியப்படுத்தியுள்ளார்.
"ஓ.பன்னீர்செல்வம் தற்போது தமிழகத்தின் முதல்வராகிவிட்டார். அவர் சிறைச்சாலைக்கு வருகை தருவது சரியல்ல. மாறாக அவர் ஆட்சி நிர்வாகத்தின் மீது கவனத்தை செலுத்த வேண்டும்" என சிறைத்துறை ஊழியர் வாயிலாக ஜெயலலிதா முதல்வர் ஓ.பி.எஸ்-க்கு அனுப்பிய தகவலில் கூறியுள்ளார்.

கடந்த திங்கள்கிழமை மாலை தமிழகத்தின் புதிய‌ முதல்வராக பதவியேற்ற ஓ.பன்னீர் செல்வம் அன்றிரவு 9 மணிக்கு பெங்களூரை வந்தடைந்தார்.அவருடன் அமைச்சர்கள் எடப்பாடி பழனிச்சாமி, நத்தம் விசுவநாதன், விஜயபாஸ்கர், வைத்தியலிங்கம் ஆகியோரும் வந்தன‌ர்.

பெங்களூரில் உள்ள மதான் நட்சத்திர ஹோட்டலில் தங்கியிருந்த அவர்கள், பரப்பன அக்ரஹாரா சிறையில் அடைக்கப்பட்டுள்ள முன்னாள் தமிழக முதல்வர் ஜெயலலிதாவை சந்திக்க நேற்று காலை 9 மணிக்கு சிறை அதிகாரிகளிடம் அனுமதி வாங்கியிருந்தனர்.

கர்நாடக உயர் நீதிமன்றத்தில் நேற்று ஜெயலலிதாவின் ஜாமீன் மனு விசாரணைக்கு வந்தது. அதில் ஜாமீன் கிடைத்தால் விடுதலை செய்தியுடன் அவரை சந்திக்கலாம் என ஓ.பன்னீர் செல்வம் காத்திருந்தார்.

மேலும் சிறை வளாகத்தில் அமைச்சரவை கூட்டம் நடத்தலாம் என திட்டமிட்டு வளர்மதி, கோகுல இந்திரா, தங்கமணி, வேலுமணி, ராமராஜ், செந்தில் பாலாஜி, மோகன் ஆகிய அமைச்சர்களும் பரப்பன அக்ரஹாராவுக்கு வரவழைக்கப்பட்டனர்.

இந்நிலையில் கர்நாடக உயர் நீதிமன்றத்தில் ஜெயலலிதாவுக்கு ஜாமீன் வழங்கப்பட‌வில்லை.
இந்தத் தகவலை கேள்விப்பட்ட ஓ.பன்னீர் செல்வம் உள்ளிட்ட அனைவரும் அதிர்ச்சி அடைந்தனர். இருப்பினும் மீண்டும் ஜெயலலிதாவை சந்திக்க அவரிடம் அனுமதி கேட்டனர். ஆனால், ஜெயலலிதா யாரையும் சந்திக்க விரும்பவில்லை என கூறிவிட்டார்.

எனவே ஒரு நாள் முழுவதும் பெங்களூரில் காத்திருந்த தமிழக முதல்வர் ஓ.பன்னீர் செல்வம் உட்பட 10-க்கும் மேற்பட்ட அமைச்சர்களும் நேற்று மாலை 5 மணிக்கு பெங்களூரில் இருந்து சென்னை திரும்பினர்.

ஜெயலலிதாவின் ஜாமீன் மனு இன்று மீண்டும் விசாரணைக்கு வருகிறது. ஜாமீன் கிடைத்த பிறகு தங்களை ஜெயலலிதா சந்திப்பார் என பன்னீர்செல்வம் உள்ளிட்டோர் காத்திருக்கிறார்கள் எனக் கூறப்படுகிறது.

இதற்கிடையே முன்னாள் பிரதமர் தேவகவுடா ஜெயலலிதாவை செவ்வாய்க்கிழமை சந்திக்க அனுமதி கேட்டுள்ளார். அவருக்கு அனுமதி வழங்கப்படவில்லை எனக்கூறப்படு கிறது.

பெங்களூரில் உள்ள பரப்பன அக்ரஹாரா மத்திய சிறையில் அடைக்கப்பட்டுள்ள தமிழக முன்னாள் முதல்வர் ஜெயலலிதா உள்ளிட்ட நால்வர் குறித்தும் பல்வேறு செய்திகள் உலா வருகின்றன. 

அதில் 90 சதவீதம் தவறானவை என சிறைத்துறை அதிகாரிகள் தெரிவித்துள்ளனர்.

உண்மை நிலையை அறிந்து கொள் வதற்காக சிறையில் ஜெயலலிதாவை நேரில் சந்தித்தவர்களிடமும் சில சிறைத்துறை அதிகாரிகளிடமும் பேசினோம்

. அவர்கள் அளித்த தகவல் வருமாறு:

வருமான வரி செலுத்துபவர் என்ப தாலும், முக்கிய அரசியல் தலைவர் என்பதாலும் பரப்பன அக்ரஹாரா சிறை யில் ஜெயலலிதாவுக்கு ‘ஏ-கிளாஸ்' அறை ஒதுக்கப்பட்டுள்ளது. ‘விஐபி'கள் அடைக் கப்பட்டுள்ள பகுதியில் ஆண்களுக்கும் பெண்களுக்கும் தனித்தனி கட்டிடம் இல்லை. எனவே மற்ற விஐபிகள் இருக் கும் பகுதியிலேயே ஜெயலலிதா உள்ளிட்ட நால்வரும் இருக்கிறார்கள்.

மேலும் ஜெயலலிதாவின் உடல் நிலையையும் வயதையும் கருத்தில் கொண்டு சிறைத்துறை நிர்வாகம் அவருக்கு அதிக‌ கட்டுப்பாடுகளை விதிக்க வில்லை. அதேபோல நீதிபதி டி'குன்ஹா வும் ஜெயலலிதாவுக்கு வழங்க வேண்டிய வசதிகள் குறித்து எதுவும் தெரிவிக்க வில்லை. எனவே சிறைத்துறை விதிமுறை களின் அடிப்படையில் அவருக்குஅனைத்து விதமான உதவிகளும் வழங்கப்பட்டுள்ளன.

ஜெயலலிதா தங்கியிருக்கும் அறையில் கலர் டி.வி., மின்விசிறி, மெத்தையுடன் கூடிய கட்டில், மேஜை நாற்காலி ஆகிய வையும் இருக்கின்றன. அறையுடன் இணைந்த தனி கழிப்பறை வசதியும் இருக்கிறது. அவரது உடல்நிலையை கருத்தில்கொண்டு வெளியிலிருந்து உணவு கொண்டுவர அனுமதிக்கப்படுகிறது.

மேலும் ஜெயலலிதாவுக்கு கைதிகளுக் கான வெள்ளை சீருடையும் வழங்கப்பட வில்லை. வழக்கமான உடைகளை அணிந்து கொள்ள அனுமதி அளிக்கப் பட்டுள்ளது. எனவே அவருடைய உதவியா ளர்கள் இரண்டு சூட்கேஸ்களில் உடைகளை கொண்டுவந்து கொடுத்துள்ளனர்.

மருத்துவ வசதி

ஜெயலலிதாவின் உடல்நிலையைக் கருத்தில்கொண்டு தினமும் காலை 9 மணிக்கும் மாலை 7.30 மணிக்கும் சிறை மருத்துவர் பரிசோதனை மேற்கோள்கிறார். தேவையான நேரத்தில் முதலுதவி செய்யவும் வசதிகள் செய்யப்பட்டுள்ளன. இந்நிலையில் அவரது குடும்ப மருத்துவர் திங்கள்கிழமை ஜெயலலிதாவை சந்தித்து சில பரிசோதனைகளை செய்தார். மேலும் அவருக்கு தேவையான மருந்து, மாத் திரைகளையும் வழங்கியுள்ளார்.

ஜெயலலிதாவுக்கு நீரிழிவு, ரத்த கொதிப்பு, இதயக்கோளாறு உள்ளிட்ட நோய்கள் இருப்பதால் எண்ணெய் தவிர்த்த உணவை சாப்பிடுமாறு அறிவுறுத் தப்பட்டுள்ளார். எனவே அதிக அளவில் பச்சைக் காய்கறிகள், பால், மோர், பழங்கள் ஆகியவற்றை சாப்பிடுகிறார். இது தவிர வெளியிலிருந்து கொண்டுவரப்படும் இட்லி, பிரட், சாண்ட்விச் மற்றும் வீட்டில் சமைத்து கொண்டுவரப்படும் உணவையும் சாப்பிடுகிறார். உணவுப் பொருட்கள், மருந்து, மாத்திரைகளை வைத்துக் கொள் வதற்காக அவருக்கு குளிர்சாதன வசதியும் வழங்கப்பட்டுள்ளது.

தன்னை பரிசோதிக்க வரும் மருத்துவர், சிறை காவலர்களிடம் சரளமாக கன்னடத்தில் பேசுகிறார். சில நேரங்களில் சசிகலா, இளவரசிக்கு தேவையான வசதிகளையும் சிறை அதிகாரிகளிடம் கன்னடத்தில் பேசி செய்து தருகிறார். அவருடைய வேண்டுகோளுக்கு இணங்க தினமும் காலையில் 3 தமிழ், 2 ஆங்கில செய்தித்தாள்க‌ள் வழங்கப்படுகின்றன.

சுதாகரனுக்கு சிகிச்சை
சிறையில் ஜெயலலிதா வசதியாக இருக்கும் அதேநேரத்தில் சசிகலாவும், இளவரசியும் மனம் உடைந்து போய் இருக் கிறார்கள். அவ்வப்போது அவர்களுக்கு ஜெயலலிதா ஆறுதல் கூறி வருகிறார். இந்நிலையில், கடந்த சனிக்கிழமை நள்ளிரவில் சுதாகரனுக்கு உடல்நிலை பாதிக்கப்பட்டது.
அதனைத் தொடர்ந்து சிறைச்சாலை வளாகத்தில் உள்ள மருத்துவமனையில் அனுமதிக்கப்பட்ட சுதாகரனுக்கு இதுவரை 4 பாட்டில் குளுக்கோஸ் ஏற்றப்பட்டு, உரிய சிகிச்சை அளிக்கப்பட்டதாக சிறைத்துறை வட்டாரங்கள் தெரிவிக்கின்றன.

எடியூரப்பா இருந்த அறை
நிலமோசடி புகாரில் சிறைக்கு சென்ற கர்நாடக முன்னாள் முதல்வர் எடியூரப்பா அடைக்கப்பட்டிருந்த அறையில்தான் ஜெய லலிதா அடைக்கப்பட்டுள்ளார்.

பரப்பன அக்ரஹாரா மத்திய சிறையில் உள்ள ஜெயலலிதாவுக்கு பாதுகாப்பு அதிகாரியாக‌ சிறைத்துறை ஏடிஜிபி ககன் தீப் நியமிக்கப்பட்டுள்ளார். இதற்கான அறிவிப்பை கர்நாடக அரசு திங்கள்கிழமை வெளியிட்டுள்ளது.
சிறையில் அடைக்கப்பட்டிருக்கும் விஐபி கைதிகளுக்கு பலத்த பாதுகாப்பு அளித்துவரும் சிறைத்துறை ஏ.டி.ஜி.பி. க‌கன் தீப்புக்கு கூடுதல் பொறுப்பு வழங்கப்பட்டுள்ளது.

சிறை வளாகத்துக்கு வெளியில் ஊரடங்கு உத்தரவு பிறப்பிக்கப்பட்டு, சுமார் 500 போலீஸார் பாதுகாப்பு பணியில் ஈடுபட்டுள்ளனர். ஜெயலலிதாவை காணவரும் அனைவரும் சிறை வளாகத்துக்கு வெளியே நிறுத்தப்படுகின்றனர். 

ககன்தீப் ஏற்கெனவே முன்னாள் முதல்வர் எடியூரப்பா, முன்னாள் அமைச்சர்கள் ஜனார்த்தன ரெட்டி, கிருஷ்ணய்ய ஷெட்டி ஆகியோருக்கு பாதுகாப்பு அதிகாரியாக இருந்துள்ளார் என்பது குறிப்பிடத்தக்கது.

முன்னாள் முதல்வர் ஜெயலலிதாவும், அவரது தோழி சசிகலாவும் ஜெயா பப்ளிகேஷன்ஸ் நிறுவனத்திற்கு சந்தாக்கள் பெற்றது வாயிலாக ரூ.14 கோடி பெறப்பட்டதாக, கிரிமினல் வழக்கு பதிவு செய்யப்பட்ட பின்னர் போலியாக ஆவணங்களை உருவாக்கியுள்ளனர்.

சொத்துக் குவிப்பு வழக்கில், பெங்களூர் சிறப்பு நீதிமன்ற நீதிபதி ஜான் மைக்கேல் டி’குன்ஹாவின் இந்த முடிவே ஜெயலலிதா உள்ளிட்ட 4 பேரை குற்றவாளியாக அறிவித்து தீர்ப்பு வழங்கக் காரணம்.

சந்தாத் திட்டத்தின் கீழ், ரூ.14 கோடி பணம் ஈட்டப்பட்டதாகவும், ஒரு தனிநபரிடம் இருந்து சந்தாவாக பெறப்பட்ட ரூ.3000 பணத்திற்கும் செய்தித்தாளின் ஒரே ஒரு பிரதி மட்டுமே அனுப்பிவைக்கப்பட்டுள்ளது.

சந்தா திட்டத்தை தீவிரமாக ஆய்வு செய்த நீதிபதி டி’குன்ஹா, சொத்துக் குவிப்பு வழக்கில் குற்றப்பத்திரிகை தாக்கல் செய்யப்பட்ட பிறகே, சந்தா திட்டம் துவக்கப்பட்டிருக்கிறது. 

கிரிமினல் வழக்கு பதிவு செய்யப்படுவதற்கு முன்னர் இருந்தே சந்தா திட்டம் அமலில் இருந்ததற்கான எவ்வித சாட்சியமும் இல்லை என சுட்டிக்காட்டியிருக்கிறார்.

சந்தா பெறப்பட்டது தொடர்பான வருமான வரிக் (ஐ.டி.) கணக்குகள் சரியாக உள்ளதாக டிபென்ஸ் தரப்பு வழக்கறிஞர் வாதிட்டபோதும், அதனை தகர்தெறிந்த நீதிபதி குன்ஹா, "1998-ல் சம்பந்தப்பட்ட நிறுவனங்கள் தரப்பில் வருமான வரிக் கணக்கு தாக்கல் செய்யப்பட்டதாக வெளியான செய்திகளே அப்படி ஒரு திட்டம் இருப்பதையே வெளிச்சத்திற்கு கொண்டுவந்ததாக" கூறியுள்ளார்.

எனவே, சொத்துக் குவிப்பு வழக்கில், ஜெயலலிதா தரப்பில் தெரிவிக்கப்பட்ட வாதங்கள் விசாரணை நீதிமன்ற நீதிபதியை சமரசம் செய்யும் அளவில் அமையவில்லை. 

ரூ.14 கோடி பணம், ஜெயா பப்ளிகேஷன் சந்தா வாயிலாக பெறப்பட்டது என்ற வாதத்தை நீதிபதி முற்றிலுமாக நிராகரித்துள்ளார்.

நீதிபதி குன்ஹா கூற்றின்படி, கிரிமினல் வழக்கு பதிவான பிறகே சந்தா திட்டம் துவக்கப்பட்டுள்ளது. 

1995-ல் அவரது வளர்ப்பு மகன் திருமணத்திற்கு செலவழிக்கப்பட்ட பல கோடி ரூபாய் பணம் உறவினர்களாலும், கட்சித் தொண்டர்களாலும் அளிக்கப்பட்டது என்பதையும் நீதிபதி ஏற்கவில்லை.

No tough questions at AGM despite alleged violation of rules, final results of shareholder vote by end of the week

Bangalore/Mumbai: It was over in 45 minutes. See, I told you it would be easy,” UB Group chairman Vijay Mallya told a director of United Spirits Ltd. To which the director replied, “Yes, I’m surprised. I thought we’d have to face questions from shareholders.”
The above conversation, recounted by two people who heard it, referred to the annual general meeting of United Spirits, which is investigating whether the company and some of its executives violated accounting and other rules.Mint couldn’t independently confirm whether the conversation took place.

Despite the inquiry and pressure from some analysts to remove Mallya from the board of United Spirits, the embattled UB Group promoter is likely to get re-elected as chairman of the company, which is now controlled by Diageo Plc.
United Spirits shareholders also approved an increase in the pay of chief financial officer (CFO) P.A. Murali, according to provisional results of voting at the annual general meeting held on Tuesday.
The final results of the shareholder vote will be released before the end of the week.
Diageo, the world’s largest distiller, now owns roughly 54.78% of United Spirits after it bought an additional 26% of the company’s shares from public shareholders for £1.11 billion in July. It first bought a 25% stake in United Spirits from India’s largest liquor company and UB Group in July 2013. Mallya’s UB Group now owns less than 5% of United Spirits, after some lenders of Kingfisher Airlines Ltd sold United Spirits shares that were pledged against borrowings.
Coming in to the AGM, some analysts had recommended removing Mallya and even Murali from the board of United Spirits, which is investigating whether the company and its executives violated accounting and other rules.
Earlier this month, proxy advisory firm Institutional Investor Advisory Services India Ltd recommended that shareholders vote against the resolutions for chairman Mallya’s reappointment and also suggested that CFO Murali should resign as director and his pay should not be increased.
“There were no tough questions for Mallya or for anyone. Mallya blamed the media and banks for his troubles,” one of the people cited above said.
Soon after United Spirits reported its thrice-delayed fourth-quarter earnings in September, it initiated an inquiry into the accounting practices of the company as several cases of suspected financial impropriety surfaced.
United Spirits, the owner of popular whisky brands such as McDowell’s No.1and Bagpiper, said the inquiry would look at whether the company and its executives had violated rules by lending money to UB Group companies. The “detailed and expeditious inquiry” would also cover some agreements allegedly entered into by United Spirits with a Kingfisher creditor and certain claims made by United Spirits debtors, some of whom are now refusing to repay the company.
Kingfisher and its directors, including Mallya, were declared wilful defaulters by at least two lenders of the grounded airline, which owes more than Rs.7,500 crore to creditors. Kingfisher said on Saturday it secured a stay from the Calcutta high court on the wilful defaulter declaration by United Bank of India, one of the airline’s several lenders.
Four United Spirits board members appointed by Diageo, all of whom are among the most respected corporate professionals in India, have quit over the past six months; earlier this month, three of them said they wouldn’t offer themselves for re-appointment.
A United Spirits spokesperson didn’t immediately respond to an email seeking comment.


Debt Recovery Tribunal to auction Deccan Chronicle promoters’ private jet

HYDERABAD: In an embarrassment to the promoters of ailing media house Deccan Chronicle Holdings(DCHL), theDebt Recovery Tribunal (DRT) has decided to auction the eight-seater corporate jet in which the media house owners toured around the world for years. 

The move comes months after ICICI Bank, one of the key lenders of the media house, approaching the DRT accusing the DCHL promoters of defaulting on loans of some Rs 500 crore. 

The Hawker 400 is a twin-engine jet corporate aircraft, which was imported from the US based Raython Aircraft Company in 2007. 

During April last year, ICICI Bankhad moved a local court in Hyderabad against the Deccan Chronicle promoters after a cheque issued for Rs 350 crore by them bounced. ICICI was among dozen odd lenders that dragged the DCHL promoters to various courts involving defaults and cheque bounces. 

"DRT has ordered auctioning the corporate jet of Deccan Chronicle on June 2 and we have accordingly sought bids from interested parties through e-auction process," the tribunal appointed advocate commissioner K. Buchi Babu told ET. 

Babu said the reserve price was kept at Rs 9.75 crore and the bidders were asked to ensure an earnest money deposit of Rs 1 crore to participate in the e-auction, which is scheduled to take place on October 17. The said aircraft is currently at New Delhi's India Gandhi International Airport and the interested registered bidders would be permitted to inspect the aircraft prior to the auction on October 9. 

The publisher of English dailies Deccan Chronicle, Financial Chronicle and Asian Age and Telugu daily and weekly Andhra Bhoomi has been in news since July 2012 when its financial woes came to the fore. More than a dozen lenders, both public and private, knocked on the doors of various courts across the country and DRT seeking to recover their debts running into nearly Rs 4,000 crore. 

DCHL's lenders include host of financial institutions such as Canara Bank, Corporation Bank, Indian Overseas Bank, Central Bank of India, Andhra Bank, Jammu & Kashmir Bank, IFCI, LICAxis Bank ICICI Bank, HDFC Bank, Future Capital, Religare Finvest, Kotak Mahindra Bank Tata Capital Ltd, PVP Capital Ltd, National Pension System Trust and Yes Bank Ltd, among others. 

Following the plea by one of the lenders, Canara Bank, which suspected an accounting fraud, the country's premier investigating body Central Bureau of Investigation last year initiated a probe into DCHL books and registered cases against the company and promoters. 

Several lenders have also moved against each other claiming rights over the assets mortgaged by the DCHL promoters including titles and trademarks of Deccan Chronicle, Asian Age, Financial Chronicle and Andhra Bhoomi. Some lenders even exercised the option over the assets charged to them and took possession of them after the company and promoters failed to clear their dues.

Coal Block Verdict: Banks to Ask RBI for Recasting Loans, Says Financial Services Secretary

Mumbai: Acknowledging that the Supreme Court's order on mass cancellation of coal block licences may impact banks' asset quality, a top Finance Ministry official on Monday said the lenders will approach the Reserve Bank of India (RBI) for restructuring such assets.

"Some impact may be there, and what exactly it will be is being assessed. The banks will be talking to RBI so that they are given some kind of flexibility in restructuring those accounts...efforts will be made to avoid these accounts from becoming NPAs," Financial Services Secretary G S Sandhu said in Mumbai.

He was talking to reporters on the sidelines of the annual general meeting of Indo-American Chamber of Commerce. The Financial Services Department, which oversees functioning of all the 27 state-run banks - which control nearly three-fourths of banking system - is also talking to the coal and power ministries to ensure that the fuel supply alternatives are put in place, he said.

On the affected sectors, Mr Sandhu said banks have lent to power companies and steel plants which in turn have coal linkages with the cancelled coal mines.

Indian Banks Association, which represents lenders' managements, had discussed the matter at a meeting last week and hinted at seeking a "regulatory forbearance" in case there is impact on the asset quality from the affected accounts.

The Supreme Court on September 25 cancelled allocation of 214 coal blocks made since 1993, impacting at least 11 corporate groups like JSW Steel and Hindalco. Bankers point out that only 46 of these mines are operational and implications of the ruling will have to be studied.

Mumbai/New Delhi: The Supreme Court (SC) order de-allocating 214 coal blocks will dent the profitability of metal and mining companies and power producers, put their credit ratings under pressure and possibly lead to an increase in funding costs, analysts said on Thursday.
The full fallout of Wednesday’s ruling, which will also hit banks that have exposure to the users of the captive mines, was still being measured in the boardrooms of companies that have trillions of rupees in investment locked up in the mines and their end-use plants.
Stock indices tumbled to a one-month low as the ruling weighed heavily on investors in power, metal and bank stocks.
An SC bench headed by Chief Justice R. M. Lodha cancelled the allocation of all but four coal blocks awarded between 1993 and 2010, having a month earlier ruled that the process was illegal, arbitrary and had resulted in the “unfair distribution of national wealth”.
The 214 blocks will now have to be re-auctioned in a fresh process that will commence in the next financial year.
The ruling also set in motion the attendant problem of unwinding investments and loans already made in the projects.
According to credit rating agencies, metal and mining firms may see their operating margins get squeezed and face higher funding costs. Companies whose mines were operational will be the worst hit.
Crisil Research, an arm of rating agency Crisil Ltd, listed 23 companies including Jindal Steel and Power LtdHindalco Industries LtdGVK Power and Infrastructure Ltd and Essar Power Ltd that will lose operational mines.
Crisil expects these companies to witness “a sharp decline in profitability post 2014-15, as they would have to substitute captive coal with imported coal which is about four times more expensive”.
“In 2015-16, impacted players in the sponge iron and aluminium sectors are expected to witness a 900-1,000 basis points (bps) and 300-400 bps decline respectively, in operating profitability,” Crisil said. One basis point is one-hundredth of a percentage point.
The ruling threatens to disrupt the power sector in a chronically energy-short country where captive power makes up a tenth of the generation capacity.
The SC ruling may lead to a spike in coal prices, which in turn would squeeze margins, said Rajesh Mokashi, deputy managing director at Care Ratings Ltd.
“For metal companies whose mines stand de-allocated, the SC ruling has increased the uncertainty regarding the coal supplies and pricing...an unwarranted spike in the price of coal in India (due to the ensuing demand-supply mismatch following the SC ruling) would hurt the operating margins of metal companies as the higher production cost would largely have to be absorbed,” Mokashi said.
He added: “The difference between the cost of thermal grade coal produced from captive mines and procured from the market is almost four times and the entities which operate on cost-plus basis (mostly state utilities) would ultimately pass on the hike to offtakers thereby restricting impact on their credit profile,” Mokashi said.
Uncertainty stemming from the SC ruling may also hurt the fund-raising plans of some companies that had been hoping to raise funds either via non-convertible debentures (NCDs) or raising equity capital through a qualified institutional placement (QIP).
State-owned NTPC Ltd, for example, has approvals to raise up to Rs.13,000 crore by selling bonds, while Tata Power Co. Ltd has the go-ahead to raiseRs.7,000 crore by selling NCDs. Tata Steel LtdJSW Energy LtdJSW Steel LtdHindalco Industries, Jindal Steel and Power and GVK Power and Infrastructure have also taken approvals from shareholders to raise funds.
Reacting to the order, Hindalco Industries said only one of its four cancelled coal blocks is operational, adding that the company was evaluating the implications of the ruling, which imposed a fine of Rs.295 per tonne of coal extracted on 42 functional mines that were allowed to continue operating until the end of March 2015.
The company said the penalty would lead to a one-time hit of Rs.500 crore to it.
“The only incremental impact because of the cancellation of coal blocks would be on the cost of production at Hirakud smelter starting April 2015, which is not expected to be significant,” the company said.
Jindal Steel and Power, in a stock exchange filing, said it was evaluating the material impact and its consequences, if any, of the SC order.
The company, which had eight coal blocks cancelled, is also seeking legal and administrative remedies on the Rs.295 per tonne levy imposed by the top court, Bloomberg reported on Thursday, citing a call with Ravi Uppal, managing director and group chief executive officer. According to the report, Uppal also said the company would look at importing coal and buying more from the domestic market to replace the production from one of the mines—Gare Palma IV—that was in production and will now have to close in March 2015. Jindal Steel and Power is India’s fifth-largest steelmaker.
According to a submission by the Coal Producers Association to the apex court, industry has invested in excess of Rs.2.57 trillion in 157 blocks and Rs.4 trillion in end-use plants. Out of this, banks and financial institutions have lent about Rs.2.5 trillion and State Bank of India (SBI) alone has lent more thanRs.78,000 crore.
SBI, however, contested these figures in a statement on Thursday, saying, “the exposure of the bank to the affected companies is substantially lower. State Bank of India does not apprehend any major problem/difficulty in recovery of the above dues”.
Other lenders, too, downplayed the impact.
“If fresh bidding is invited for the coal blocks, the existing companies will again re-bid and secure some of the blocks. If a new investor comes, he will have to buy the assets, along with the debt, from the existing companies. It’s not that everything is lost,” said M.S. Raghavan, chairman and managing director, IDBI Bank Ltd.
Stock indices tumbled.
The 30-share Sensex ended lower by 1%, or 276.33 points, at 26,468.36 points, while the National Stock Exchange’s 50-share Nifty shed 1.1%, or 90.55 points, to close at 7,911.85 points. Both indices closed at their lowest level since 26 August.
Shares of Jindal Steel and Power fell 7.83% on the BSE to close at Rs.174.85 while Hindalco shares were down by 4.32% and closed at Rs.149.55 per share. The broader BSE metal index fell 3%.
SBI lost 4.38% to Rs.2,378.35 and ICICI Bank Ltd fell 3.28% to Rs.1,466.85.Allahabad Bank declined 12.3% to Rs.96.95, Union Bank of India fell 7.38% toRs.190 and IDBI Bank gave up 11.03% to end at Rs.60.10. The BSE Bankex ended 2.69% lower at 17,525.09.
